In New South Wales, banks and other lenders often require borrowers or guarantors to obtain independent legal advice at the time their loan documents are signed. This requires a Certificate of Independent Legal Advice in the form of a statutory declaration signed by the borrower or guarantor and witnessed by a solicitor.
